Our Policies

How date requests, fees, and cancellations work at Henning.

Date Requests & Holds

Submitting a date request holds the date for 48 business hours (shown as Pending on the calendar); it is not a confirmed booking. The hold gives the parties time to confirm; if it is not confirmed the date returns to open. For a single matter, up to 2 dates may be held at once, and once one date is confirmed the other hold is released.

Fee Policy

Below are our standard fees. Rates, minimums, and travel terms vary by neutral; see the Fees & Policies section of the individual neutral's bio page for theirs.


Administrative

$400 per party, per day.


Neutral Rates

Each neutral's rates are listed on their bio page, or filter the panel by rate to compare. Rates are per party, per hour unless otherwise noted.

Hourly fees are the same for any additional time spent on document review, research, written findings of fact/law, or, if necessary, to prepare an informed award or evaluation.


Travel

Standard: Travel time outside the metro Atlanta area: $125.00 per hour for travel time, plus reasonable transportation, lodging, and meal expenses.

There is a minimum hearing length of eight (8) hours for out-of-town mediations.


Minimum

The default is a four (4) hour minimum charge for all hearings, including cancellations, postponements, or rescheduling.

Payment & Billing

Below are our standard billing terms. The terms printed on your invoice control that invoice; a matter may carry shorter terms than the standard.


Contract

Our contract for services is with the attorney(s). We extend credit, with no advance deposit required, based on the attorney(s) credit. The attorney, in turn, collects from their client(s). Therefore, we expect payment, within the terms allowed, from the attorney(s) regardless of client activity.


Split

All fees, expenses, costs, and travel time will be split equally among all parties, unless otherwise agreed in writing.


Terms

Mediation invoices are due Net 30 from the invoice date. Deposits are due within fourteen (14) days, or before the hearing date if it falls sooner.


Arbitration

Advance deposits are required for all arbitrations. All fees must be paid in full, by all parties, before an arbitration award will be published to any party.


Pro Se

Self-represented parties must pay a deposit covering their share of the fees in advance of the hearing.


Outstanding Balances

Accounts with an outstanding balance or credit hold are required to place a deposit on all matters.

Cancellation Policies

Below are the standard cancellation policies. Some neutrals set their own terms; please check the individual neutral's fee structure (on their bio pages) for their policy. You may also request a copy from a case coordinator by calling us or sending an email to scheduling@henningmediation.com.


Mediation

Written confirmation of your hearing will be emailed to all parties within 48 hours of the case information being provided to HMA.

Our staff will re-confirm the hearing date(s) and time by email and/or telephone two (2) weeks in advance of the scheduled hearing date(s). If the matter is cancelled or rescheduled at or before this time, no cancellation fees will apply. Our case coordinators will be happy to assist you in rescheduling your matter for another date that is suitable for all parties.

After a hearing date(s) has been scheduled and notices have been sent, no cancellation fee shall be charged if the mediation or arbitration is cancelled or rescheduled more than FOURTEEN (14) days from the date scheduled. Such cancellation or rescheduling notice must be received in writing.

If the hearing date(s) is cancelled or rescheduled, for any reason, within FOURTEEN (14) days of the original date set, a cancellation fee of 4 HOURS will be charged at the assigned neutral's hourly rate to each party, for each scheduled date.

Cases that are booked within the fourteen day cancellation window will be considered confirmed, and will be subject to the cancellation policy detailed above.

All requests for cancellation must be received in writing, preferably via email to scheduling@henningmediation.com. The request should include the HMA matter #, the style of the case, the original hearing date, and the reason for the requested cancellation. Please copy all participants in the matter on your cancellation request.

We trust this policy will allow our clients to secure hearing dates with their preferred neutral and also be fair to our mediators who are making the commitment to work your case on the date scheduled.

This cancellation policy is sent with the confirmation email to all known participants prior to the hearing.


Arbitration

Written confirmation of your hearing will be emailed to all parties within 48 hours of the case information being provided to HMA.

Except as modified by the Arbitrator(s) in its Case Management Order, after a hearing date(s) has been scheduled and notices have been sent, no cancellation fee shall be charged if the arbitration is cancelled or rescheduled more than TWENTY-ONE (21) days from the earliest date scheduled. Such cancellation or rescheduling notice must be received in writing.

If the hearing date(s) is cancelled or rescheduled, for any reason, between TWENTY-ONE (21) days and SEVEN (7) days of the original date set, a cancellation fee of 4 HOURS per arbitrator will be charged at the assigned neutral's hourly rate to each party, for each scheduled date, plus a $400 per day per party administrative fee.

If the hearing date(s) is cancelled or rescheduled, for any reason, within SEVEN (7) days of the original date set, a cancellation fee of 8 HOURS per arbitrator will be charged at the assigned neutral's hourly rate to each party, for each scheduled date, plus a $400 per day per party administrative fee.

Cases that are booked within the TWENTY-ONE (21) day cancellation window will be considered confirmed, and will be subject to the cancellation policy detailed above.

The request should include the HMA matter #, the style of the case, the original hearing date, and the reason for the requested cancellation. Training Cancellation

Full Refund Eligibility

If notice of cancellation is given 14 calendar days or more in advance of the scheduled training, the registrant’s payment may be refunded. All refunds are issued by check. Outside of this window, no refunds will be issued.


Rescheduling Options

A registrant who cancels between 8 and 13 days before the training may reschedule once to another available training date at no additional charge. A registrant who cancels between 1 and 7 days before the training may reschedule once to another available date for a $175 fee.


No-Show Policy

If a registrant fails to attend or notify Henning on the first day of the scheduled class, the registration will be automatically cancelled. Such registrations cannot be transferred or rescheduled, and no refund will be issued.


Cancellation of Training Program by Henning

To meet program requirements, sufficient enrollment is necessary to conduct a training. In the rare event that a training date lacks adequate enrollment, or Henning must otherwise cancel a scheduled program, registrants will be notified as soon as possible and may elect either to transfer to another available training date or to receive a full refund of fees paid. Refunds are issued by check.
